This research, entitled: Features of Comparative Jurisprudence according to Imam Ibn Mawdud al-Mawsili al-Hanafi (d. 683 AH) through his book Al-Ikhtiyar li’l Jalīl Al-Mukhtar, aims to: explain the description of the printed book from the book Al-Ikhtār li’l Al-Mukhtar, compare its manuscript version on which the investigators relied, and show the features of comparative jurisprudence in Imam Ibn Mawdud Al-Mawsili, and what was his approach to preferences and their discussion, and his presentation of comparative jurisprudential issues within and outside the Hanafi school of thought.
The nature of the research required that it consist of: an introduction, followed by the problem of the research, its importance and objectives, and previous studies in it, and three sections: the first: Imam Ibn Maudud al-Mawsili and his book al-Ikhtiyar, the second: manuscripts and publications of the book al-Ikhtiyar, and the third: features of comparative jurisprudence according to Imam Ibn Maudud al-Mawsili, and it concluded. The most important results and recommendations reached by the researcher.
The research gave a brief introduction to Imam Al-Mawsili, and highlighted the importance of his book Al-Ikhtiyar for explaining Al-Mukhtar, with reference to the most important editions that served his book, and presented information about the manuscripts of the Book of Al-Ikhtiyar that exist in the world and what was achieved from them and what was not achieved. It also showed the efforts of Imam Ibn Mawdud Al-Mawsili in comparative jurisprudence in The seventh century AH, by revealing the most prominent features of his comparative jurisprudence in his book Al-Ikhtiyar.
The researcher reached many results, including: Imam Ibn Mawdud Al-Mawsili is considered one of the most prominent jurists who drew the features of comparative jurisprudence in the seventh century AH, through his book Al-Ikhtiyar li’lil Al-Mukhtar, this book which is considered to be of interest to later jurists of the Hanafi school of thought, and one of the four most important texts. approved by them, and Imam Al-Mawsili had a method in presenting issues of disagreement and comparison between Imam Abu Hanifa and his companions Abu Yusuf, Muhammad and Zufar, as well as comparing him with other schools of thought such as Al-Shafi’i. The researcher revealed thirteen landmarks of comparative jurisprudence according to Imam Al-Mawsili in his approach, with an example given. For every teacher.
The researcher recommended paying attention to the scientific legacy of Imam Ibn Maudud al-Mawsili, benefiting from his excellence in it, and highlighting the role of jurists in establishing the methodology of comparative jurisprudence. He also recommended collecting the features of comparative jurisprudence according to advanced jurists.

هذا البحث بعنوان: معالم الفقه المقارن عند الإمام ابن مودود المَوْصِلي الحنفي (ت: 683هـ) من خلال كتابه الاختيار لتعليل المختار، يهدف إلى: بيان وصف المطبوع من كتاب الاختيار لتعليل المختار، ومقارنة نسخه المخطوطة التي اعتمد عليها المحققون، وإظهار معالم الفقه المقارن عند الإمام ابن مودود المَوْصِلي، وكيف كان منهجه في الترجيحات ومناقشتها، وعرضه للمسائل الفقهية المقارنة داخل المذهب الحنفي وخارجه.
واقتضت طبيعة البحث أن يتكون من: مقدمة، ويليها مشكلة البحث وأهميته وأهدافه، والدراسات السابقة فيه، وثلاثة مباحث: الأول: الإمام ابن مودود المَوْصِلي وكتابه الاختيار، والثاني: مخطوطات ومطبوعات كتاب الاختيار، والثالث: معالم الفقه المقارن عند الإمام ابن مودود المَوْصِلي، واختتم بأهم النتائج والتوصيات التي توصل إلى الباحث.
عرَّف البحث بالإمام الموصلي تعريفًا موجزًا، وبين أهمية كتابه الاختيار لتعليل المختار، مع الإشارة إلى أهم الطبعات التي خدمت كتابه، وعرض معلومات حول مخطوطات كتاب الاختيار الموجودة في العالم وما حقق منها وما لم يحقق، كما أظهر جهود الإمام ابن مودود المَوْصِلي في الفقه المقارن في القرن السابع الهجري، من خلال الكشف عن أبرز معالم الفقه المقارن عنده في كتابه الاختيار.
وتوصل الباحث إلى نتائج عديدة، منها: أن الإمام ابن مودود المَوْصِلي يُعدُّ من أبرز الفقهاء الذين رسموا معالم الفقه المقارن في القرن السابع الهجري، من خلال كتابه الاختيار لتعليل المختار، هذا الكتاب الذي يعتبر محل اهتمام المتأخرين من فقهاء المذهب الحنفي، وأحد أهم المتون الأربعة المعتمدة عندهم، وكان للإمام الموصلي فيه منهجًا في عرض مسائل الخلاف والمقارنة بين الإمام أبي حنيفة وأصحابه أبي يوسف ومحمد وزفر، وكذلك مقارنته مع المذاهب الأخرى كالشافعي، وقد كشف الباحث عن ثلاثة عشر معلمًا من معالم الفقه المقارن عند الإمام الموصلي في منهجه، مع بيان مثال لكل معلم.
وأوصى الباحث بالاهتمام بالموروث العلمي للإمام ابن مودود الموصلي، والاستفادة من تميزه فيه، وبإبراز دور الفقهاء في تأسيس منهجية الفقه المقارن، كما أوصى بجمع معالم الفقه المقارن عند الفقهاء المتقدمين.
