This research addresses the investment in gold company stocks from a fiqhi (juridical) perspective, focusing on the legal classification of purchasing stocks in companies whose primary assets are gold. The study highlights the fiqhi rulings regarding gold and silver, with emphasis on the condition of equivalence and handover in financial transactions. As financial markets have evolved, the trading of gold company stocks has raised questions about the legitimacy of such transactions and their compliance with Islamic law. The research aims to evaluate the Sharia-compliant alternatives for these transactions, especially when physical handover, which is a condition for the validity of the contract, is not possible. It explores the possibility of using company management delegation or deemed handover as alternatives to actual physical handover in stock purchase contracts. The research adopts an analytical and foundational methodology to present and assess the fiqhi solutions.

يتناول هذا البحث الاستثمار في أسهم شركات الذهب من منظور فقهي، ويعرض التكييف الشرعي لعقد شراء أسهم شركات يعتمد الذهب غالباً كأصل مالي لها. يتطرق البحث إلى الأحكام الفقهية المتعلقة بالذهب والفضة، مع التركيز على شرط التماثل والتقابض في المعاملات المالية. ومع تطور الأسواق المالية، ظهرت ظاهرة تداول أسهم شركات الذهب، مما يطرح تساؤلات حول صحة هذه المعاملات ومدى توافقها مع الشريعة الإسلامية. يهدف البحث إلى تقييم البدائل الشرعية لهذه المعاملات، في ظل تعذر تحقق القبض الفعلي وهو من شروط صحة العقد. يستعرض البحث إمكانية استخدام وكالة إدارة الشركة أو القبض الحكمي كبدائل للقبض الفعلي في حالة عقود شراء الأسهم. يعتمد البحث على المنهج التحليلي والتأصيلي لعرض الحلول الفقهية وتقييمها.
