This research aims to investigate the legal provisions in the Islamic Shariah regarding the lease contracts signed before the corona pandemic and whose application has become inapplicable due to force majeure, to determine the moral consequences of the lease agreements on the payment obligations and the possibility of the tenant to terminate it due to not being able to benefit from it. The research consists of the following topics; introduction, followed by the problem, importance and objectives of the research, previous studies and then three topics. In the first topic, the legal consequences incumbent on the lease contract in the shadow of the Corona pandemic, in the second topic, the effect of the Corona pandemic on the contracts and the proofs of this effect in Islamic Sharia, in the third topic, the moral consequences incumbent on the lease contract in the shadow of the Corona pandemic are addressed.

Our research explains that the legal provisions of the lease contracts become prominent on the point of liability by bindingness between the parties of the contract and being committed to its requirements, that the receding of the morality of the contract will show effect in terms of the termination, invalidity and the amendment of the incumbent liabilities, that this will befit in the Corona pandemic experienced socially and where many ways of life have stopped. In the conclusion and suggestions section, it is stated that, if the lease contract is affected by the Corona pandemic, it is permissible to terminate the contract or reduce the rental fee according to the situation, if the lease is not affected by the pandemic, the tenant should pay the rental fee, and if the lease contract is affected by the Corona pandemic, the lessor should return the rental fee or alleviate the conditions for the tenant

Abstract in Arabic | الملخص بالعربية

يهدف هذا البحث إلى بيان الأحكام الفقهية المتعلّقة بعقود الإجارة في الشريعة الإسلامية التي أُبرمت قبل جائحة كورونا، وحالت الظروف الطارئة في تنفيذها في ظلِّ هذه الجائحة، مع معرفة الآثار الأخلاقية لعقود الإجارة على التزامات الوفاء بها، وإمكانية فسخها لعدم انتفاع المستأجر بها، وجاء البحث في الأمور الآتية: مقدمة، ويليها مشكلة البحث وأهميته وأهدافه، والدراسات السابقة فيه، وثلاثة مباحث: الأول: في الآثار الفقهية المترتبة على عقد الإجارة في ظِلِّ جائحة كورونا، والثاني: في أثر جائحة كورونا على العقود، والأدلَّة على وضعها في الشريعة الإسلامية، والثالث: حالات الإجارة في الجوائح، والآثار الأخلاقية المترتبة على عقد الإجارة في ظِلِّ جائحة كورونا.

فبينت هذه الدراسة: الأحكام الفقهية لعقود الإجارة من حيث الأصل في لزومها والوفاء بين المتعاقدين بها، والالتزام بمقتضياتها، وأن فوات الجانب الأخلاقي للعقد له تأثير على العقد بفسخه وبطلانه أو تعديل الالتزامات المترتبة عليه، وهذا ما يتناسب مع هذه الجائحة-كورونا-التي حلّت على المجتمع وتعطّل بها الكثير من جوانب الحياة، وجاءت النتائج والتوصيات بجواز فسخ عقد الإجارة، أو وضع جزء من الأجرة عن المستأجر عندما يتأثر عقد الإجارة بجائحة كورونا، بحسب ما يقتضيه الحال، وعلى المستأجر الوفاء بعقد الإجارة ما دام لم يتأثر بالجائحة، وعلى المؤجر رد الأجرة أو التخفيف عن المسـتأجر إذا تأثر عقد الإجارة بجائحة كورونا.
